Automatic Enrolment Retirement Savings System Act 2024 section 23

Disclosure of interests by members of staff of Authority or other persons

Section 23 requires staff, consultants and advisers of the Authority to disclose any material interest in matters related to their functions, and empowers the chief executive to take action where disclosure obligations are breached.

  • Any staff member, consultant or adviser of the Authority who has a material interest in a matter connected with their role must disclose that interest, and its nature, to the chief executive.
  • The person must not perform the function in question, must not influence or seek to influence any related decision, and must not make any recommendation on the matter.
  • The disclosure requirement does not apply to matters relating to employment contracts between Authority staff and the Authority itself.
  • Where the chief executive is satisfied that a person has breached these requirements, they may decide on appropriate action, up to and including termination of the person's employment contract or contract for services.
