Amendment of Workplace Relations Act 2015

Section 130 amends the Workplace Relations Act 2015 to integrate the automatic enrolment system into the existing workplace dispute resolution framework.

• The National Automatic Enrolment Retirement Savings Authority is added to the list of official bodies recognised under the Workplace Relations Act 2015.
• Disputes relating to employer obligations under sections 127 and 128 of the 2024 Act may be referred to the Workplace Relations Commission, subject to a six-month time limit from the date the dispute arose.
• Sections 127 and 128 (employer obligations) are added to the schedules covering adjudication of disputes and Labour Court appeals, giving employees formal complaint and appeal routes.
• Section 129 (penalisation of employees) is added to the schedules for complaints to and decisions of adjudication officers and Labour Court appeals, protecting employees who exercise their automatic enrolment rights.
