Automatic Enrolment Retirement Savings System Act 2024 section 101

Electronic system to be used by default

Section 101 provides that communications and services between the Authority, participants and employers under the Act are to be delivered electronically by default, and sets out when a communication is considered to have been made available and how notifications of new communications may be sent.

  • All communications and services under the Act between the Authority, participants and employers must be made available through the Authority's electronic system, subject to section 103 which allows for alternative arrangements.
  • A communication is treated as made available when it can be viewed on the system, the recipient has the necessary access details, and (where required) a notification has been sent.
  • Notifications may be sent by email, text message, post, or any other means agreed between the person and the Authority.
  • A notification is only required where the person has provided contact details or agreed an alternative notification method with the Authority; otherwise the communication is still treated as made available once it is viewable and access details have been provided.
