Authority may publish information respecting certain persons

Section 126 requires the Authority to maintain and publish a non-compliance list of persons fined or penalised by a court under the Act, with entries automatically deleted after two years.

  • The Authority must keep a list of all persons on whom a court has imposed a fine or other penalty under the Act, known as the automatic enrolment retirement savings system non-compliance list.
  • Each entry must include the person's name, trading name, legal identity, address (including any website or online location linked to the offence), the provision of the Act under which the penalty was imposed, and details of the offence and the fine or penalty.
  • The Authority may publish all or any part of the non-compliance list in whatever form it considers appropriate, including on its own website.
  • Each entry on the list must be deleted no more than two years after the date the fine or penalty was imposed.
