Automatic Enrolment Retirement Savings System Act 2024 section 109

Disclosure of certain information to Minister for Enterprise, Trade and Employment, etc.

Section 109 authorises the sharing of enrolment information between the National Automatic Enrolment Retirement Savings Authority, the Minister for Enterprise, Trade and Employment, and the Workplace Relations Commission, and restricts how that shared information may be used.

  • The Authority may share a person's enrolment information with the Minister for Enterprise, Trade and Employment or the Workplace Relations Commission, despite any general secrecy obligations
  • The Minister or the WRC may likewise transfer such information back to the Authority
  • Shared information may only be used for employment rights compliance purposes
  • Neither the Minister nor the WRC may disclose the information to any other person or for any other purpose, except to each other
