Amendment and application of Freedom of Information Act 2014

Section 106 amends the Freedom of Information Act 2014 to bring the National Automatic Enrolment Retirement Savings Authority within its scope, while setting out specific categories of records that are exempt from FOI requests.

  • The Freedom of Information Act 2014 is amended to include the National Automatic Enrolment Retirement Savings Authority (An tÚdarás Náisiúnta um Uathrollú Coigiltis Scoir) as a body subject to that Act.
  • Certain records are exempt from FOI, including confidential personal information relating to the financial or business affairs of any individual or company, and records received or created in the course of the Authority carrying out its statutory functions (unless in summary or aggregate form where individuals cannot be identified).
  • Records concerning companies, firms, funds or other entities in which the Authority has invested or could potentially invest are also exempt, as are records relating to the terms and conditions of individual staff members (unless in summary or collective form where individuals cannot be identified).
  • Despite the usual provisions allowing a phased introduction of FOI obligations for new bodies, the FOI Act applies to the Authority from the date of its establishment.
