Removal of chief executive

Section 29 sets out the grounds and procedures for the removal of the chief executive from office by the Board of the National Automatic Enrolment Retirement Savings Authority.

  • The Board may remove the chief executive by simple majority where the chief executive has become incapable through ill-health, has committed stated misbehaviour, or where removal is necessary for the effective and efficient performance of the Authority's functions.
  • Before removing the chief executive, the Board must give written notice setting out the reasons for the proposed removal and allow the chief executive at least 20 working days to make representations.
  • The Board must take into account any representations made by the chief executive, along with any other matter it considers relevant, before reaching its decision.
  • If the Board decides to proceed with removal, it must notify the chief executive, the Minister, and both Houses of the Oireachtas, providing a written statement of the decision and reasons, and must also inform the relevant Oireachtas Committee.
