Appearances before committees of Houses of Oireachtas

Section 34 sets out the arrangements for the chief executive of the Authority to attend before an Oireachtas Committee to account for the general administration of the Authority, including limitations where matters are subject to court or tribunal proceedings.

• The chief executive must attend before an Oireachtas Committee on written request to account for the general administration of the Authority, but is not required to address any matter that is the subject of court or tribunal proceedings in the State.
• Where the chief executive believes a requested matter is sub judice, he or she must inform the Committee of that opinion and the reasons; if the Committee does not withdraw its request, either party may apply to the High Court within 21 days for a determination, during which time the chief executive need not attend.
• The chief executive must not question or express an opinion on the merits of any Government policy or ministerial policy, or on the objectives of such a policy, when performing duties under this section.
• With the permission of the Committee chairperson, a member of staff of the Authority nominated by the chief executive may attend in place of the chief executive, and the same rules and restrictions apply to that nominee.
