Recovery of moneys

Section 141 provides that the National Automatic Enrolment Retirement Savings Authority may recover amounts owed under certain sections of the Act as a simple contract debt through the courts.

  • The Authority may pursue recovery of amounts due under sections 131, 138 and 139 of the Act.
  • Recovery is by way of a simple contract debt action, using the ordinary civil court process rather than any special statutory mechanism.
  • Proceedings may be brought in any court of competent jurisdiction, with the appropriate court depending on the amount involved.
  • The debt is recoverable from the person by whom it is payable, meaning the person on whom the original obligation fell.
