Social Welfare Consolidation Act 2005 section 105

Payment of benefit

Section 105 sets out the restrictions preventing duplicate payments of Carer's Benefit and related care-based social welfare payments.

  • A carer may receive only one Carer's Benefit payment, and only one Carer's Benefit may be paid in any week for the care of a particular person.
  • Carer's Benefit cannot be paid where the care recipient already receives a constant attendance increase with their Disablement Pension.
  • Carer's Benefit cannot be paid where another person already receives Carer's Allowance for looking after the same care recipient.
  • Prescribed Relative Allowance ceases when anyone becomes entitled to Carer's Benefit for caring for that same person.
