Specified period

Section 343N defines the "specified period" β€” the window of time during which social welfare benefits paid to an injured person can be recovered from a compensator.

  • The specified period begins on the date the injured person first becomes entitled to a specified benefit as a result of the personal injury.
  • The period ends after 5 years from that start date, if no earlier event occurs.
  • The period ends earlier if the compensator makes a compensation payment in final discharge of the injured person's claim.
  • The period also ends earlier if an agreement is reached treating a previous payment as the final settlement of the claim.
