Chief Appeals Officer

Section 305 provides for the designation of a Chief Appeals Officer and one or more Deputy Chief Appeals Officers from among the Minister's appeals officers.

  • The Minister must designate one of their appeals officers as the Chief Appeals Officer.
  • The Minister must also designate one or more other appeals officers to act as deputies when the Chief Appeals Officer is unavailable.
  • The deputy must be a different person from the officer designated as Chief Appeals Officer.
  • An appeals officer acting as deputy for the Chief Appeals Officer is referred to as the Deputy Chief Appeals Officer while carrying out that role.
