Social Welfare Consolidation Act 2005 section 239

Certain EU payments – entitlement to island allowance

Section 239 provides for a weekly island allowance of €12.70 for persons ordinarily resident on an island who receive a corresponding social welfare payment from another EU Member State.

  • A person must be ordinarily resident on an island to qualify for this allowance.
  • They must be entitled to or receiving a payment from another EU Member State that corresponds to specified Irish social welfare payments.
  • For certain payments (such as state pensions, widow's/widower's pensions, one-parent family payment and related death benefits), the person must also have reached pensionable age; for others (such as disablement pension increases for incapacity, invalidity pension and disability allowance), there is no age requirement.
  • The weekly allowance is €12.70, though a different amount may be prescribed by regulation.
