Application of Part

Section 343M sets out when Part 11B (Recovery of Certain Benefits) applies to compensation payments made for personal injuries, and lists the specific types of compensation that are excluded from its scope.

• Part 11B applies where a compensator makes a payment to an injured person for a non-fatal personal injury, and that person has received, is receiving, or may receive a specified social welfare benefit as a result of the injury during the specified period.
• The Part only applies to compensation payments made after its commencement, unless the payment arises from a court order, an Injuries Board order, or a settlement made before commencement.
• Certain compensation payments are excluded, including those from the Hepatitis C and HIV Compensation Tribunal, the Residential Institutions Redress Board, the Criminal Injuries Compensation Tribunal, Thalidomide-related payments, and payments under the Garda Síochána (Compensation) Acts 1941 to 2003.
• The Minister may prescribe additional tribunals, redress boards, or compensation schemes for exclusion, provided they are publicly funded, established by statute, or administered by a Minister, and the Minister is satisfied that prescribing them will promote the efficient use of funds.
