Social Welfare Consolidation Act 2005 section 328

Certificate by deciding officer, appeals officer or designated person

Section 328 provides that a signed certificate of a decision or determination made under the Act is accepted as prima facie evidence without requiring proof of the signatory's identity or official capacity.

• A document purporting to certify a decision by a deciding officer or an appeals officer under the Act is accepted as prima facie evidence of that decision
• A document purporting to certify a determination by a designated person under the Act is similarly accepted
• The certificate is treated as evidence both of the making of the decision or determination and of its terms
• There is no requirement to prove the authenticity of the signature or the official capacity of the officer or person who signed it
