Social Welfare Consolidation Act 2005 section 186E

Payments while child is resident in an institution

Section 186E sets out the rules for domiciliary care allowance when a qualified child is resident in an institution.

  • Domiciliary care allowance is generally not payable while a child is resident in an institution.
  • A reduced rate may be paid where the child temporarily stays with the qualified person for at least two days per week.
  • If a child already receiving the allowance is admitted to an institution, payment may continue for a prescribed period.
  • Regulations specify the detailed conditions and circumstances for these exceptions.
