Social Welfare Consolidation Act 2005 section 77A

Increase in disablement pension for qualified adult, qualified children etc

Section 77A sets out the additional amounts payable on top of disablement pension when a person qualifies for incapacity supplement.

  • Where the beneficiary has a qualified adult, the pension increases by the amount specified in Part 4 of Schedule 2, but only one such increase can be claimed at any time.
  • Additional amounts are payable for each qualified child living with the beneficiary, with different rates for children under 12 and children aged 12 or over, as set out in Part 4 of Schedule 2.
  • Further increases apply where the beneficiary lives alone or is ordinarily resident on an island off the coast of Ireland, at the rates specified in Part 4 of Schedule 2.
  • The child increase is halved where the beneficiary's spouse, civil partner or cohabitant is not a qualified adult, and is removed entirely if that person's income exceeds a prescribed threshold.
