Social Welfare Consolidation Act 2005 section 113B

Entitlement for state pension (transition) recipients

Section 113B provides for the transition from State pension (transition) to State pension (contributory) when a person reaches pensionable age, ensuring they receive the higher of the two pension rates.

  • A person qualifies for State pension (contributory) under this section if they have reached pensionable age and were receiving State pension (transition) immediately beforehand.
  • Only one pension may be paid to any individual under this Chapter.
  • Where a person was receiving State pension (transition), their weekly pension will be whichever is greater: the standard contributory rate or their previous transition pension rate.
  • This protective measure ensures that no one suffers a reduction in pension income when moving from the transition pension to the contributory pension.
