Regulations

Section 151 empowers the Minister to make regulations to give effect to the pre-retirement allowance.

  • The Minister can specify the qualifying age and define what periods count as retirement for eligibility purposes.
  • Regulations may clarify when a person is treated as a separated spouse or as a civil partner living apart from their partner.
  • The weekly rate of pre-retirement allowance can be varied by regulation.
  • Any rate changes must not reduce payment levels below those in force before the regulations commence.
