Social Welfare Consolidation Act 2005 section 176

Continuation of payment

Section 176 provides for the continuation of one-parent family payment for four weeks following the release of a spouse or civil partner from prison or detention.

• Applies where one-parent family payment is in payment due to imprisonment or detention of a spouse or civil partner
• The original custodial sentence or detention period must have been for at least 6 months
• Payment automatically continues for 4 weeks after the spouse or civil partner is released
• Provides transitional financial support while the family unit readjusts
