Offences

Section 343K creates a criminal offence where a relevant person fails to comply with a notice of attachment issued under Section 343H within the required timeframe.

• Where the Department issues a notice of attachment under Section 343H(1)(c) to a third party who owes money to a person who has been overpaid social welfare, the third party must comply within the specified deadline.
• If an extended compliance period applies under Section 343H(3), the third party must comply within that revised period instead.
• Failure to meet whichever deadline applies means the third party is guilty of a criminal offence.
• This provision was introduced by the Social Welfare and Pensions (Miscellaneous Provisions) Act 2013.
