Revision of determination of entitlement to supplementary welfare allowance

Section 324 allows a designated person to revise a determination or an appeals officer's decision on entitlement to supplementary welfare allowance where there is new evidence, an error, or a change of circumstances.

  • A designated person may revise an earlier determination if new evidence emerges, a mistake of law or fact was made, or there has been a relevant change of circumstances since the original determination.
  • A designated person may also revise an appeals officer's decision where the decision entitled a person to supplementary welfare allowance and there has been a relevant change of circumstances since that decision was given.
  • A determination that is currently under appeal (under section 311 or 323) cannot be revised unless the revised determination would be in the claimant's favour.
  • A "relevant change of circumstances" includes any change that occurred before or after the commencement of the Social Welfare and Pensions (No. 2) Act 2013.
