Disqualifications for injury benefit or disablement benefit and suspension of proceedings

Section 91 sets out the circumstances in which a person may be disqualified from receiving injury benefit or disablement benefit, or have their claim suspended.

  • Benefits may be withheld for up to 9 weeks, or claims suspended, where a person fails without good cause to attend medical examinations, undergo appropriate treatment, or comply with other specified requirements.
  • Requirements include following medical advice, avoiding behaviour that could hinder recovery, and being available to meet with departmental officers or medical assessors regarding the claim.
  • A person receiving injury benefit or an increase of disablement benefit under section 77 must not engage in work, unless the work falls within a prescribed class of employment or training and meets specified conditions.
  • Claimants who attend for medical examination or treatment are entitled to reimbursement of reasonable and necessary expenses, including travel costs and compensation for lost earnings.
