Social Welfare Consolidation Act 2005 section 193

Persons affected by trade disputes

Section 193 restricts entitlement to supplementary welfare allowance for workers who are unemployed due to a trade dispute at their workplace.

  • Workers unemployed because of a trade dispute work stoppage cannot claim supplementary welfare allowance for their own personal needs during the stoppage.
  • This restriction does not apply to the needs of any dependent adults or children the worker must provide for.
  • Workers who are not participating in or directly interested in the trade dispute remain fully eligible for supplementary welfare allowance.
  • Where separate departments operate distinct business activities within the same premises, each department is treated as a separate workplace for these purposes.
