Saver for repeal of Workmen's Compensation Acts

Section 97 preserves the application of the older Workmen's Compensation Acts for workplace injury cases where the right to compensation arose before 1 May 1967.

  • The Workmen's Compensation Acts (as amended by the Civil Liability Act 1961) remain in force for certain legacy cases
  • These Acts apply where a worker's right to compensation arose from employment before 1 May 1967
  • An exception exists for prescribed occupational diseases or injuries covered under Chapter 13
  • The exception applies where the compensation right arose after 1 May 1967 and the worker was already insured under the occupational injuries scheme
