Issuing of statements and revised statements of recoverable benefits by Minister

Section 343PA allows the Minister to issue (or revise) statements of recoverable benefits on their own initiative, even where the compensator or the Board has not applied for one.

  • The Minister can issue a statement of recoverable benefits where a compensator has paid compensation, or the Board has issued a payment order, without either having applied for such a statement.
  • A revised statement can be issued if, after the original statement, a decision is made to award or vary a specified benefit payable to the injured person.
  • Whenever the Minister issues a statement or revised statement to a compensator or the Board, a copy must also be sent to the injured person.
  • The Minister may make regulations specifying the information that compensators or injured persons must provide to enable identification of the injured person and the benefits they have received.
