Transfer of personal data, under Part 11B, to compensator in United Kingdom

Section 343PB provides the legal basis for the Minister to transfer an injured person's personal data to a UK-based compensator, so that the recovery of specified social welfare benefits can operate across the Irish–UK border following Brexit.

• Where a compensator is subject to UK law and an injured person has received, is receiving, or may receive a specified benefit, the Minister must transfer certain personal data about the injured person to that compensator.
• The data may be included in a statement of recoverable benefits, a revised statement of recoverable benefits, or a refund issued by the Minister.
• The transfer of personal data is necessary to enable the UK-based compensator to pay the Minister the amount of any specified benefits received, or receivable, by the injured person.
• The personal data transferred are data within the meaning of Article 4 of the EU General Data Protection Regulation (GDPR), limited to what is required for the effective operation of the recovery scheme and already held by the Minister for that purpose.
