Payments in respect of loss of purchasing power

Section 243 provides for compensation where payment of a social welfare claim is delayed for more than 12 months due to departmental fault.

  • Where a benefit claim under section 241 is delayed beyond 12 months mainly due to circumstances within the Department's control, and the claimant has not contributed to the delay, regulations may provide compensation for loss of purchasing power.
  • The compensation for loss of purchasing power is subject to such conditions and circumstances as may be prescribed in regulations.
  • The Minister may also make regulations to reimburse actual and necessary costs incurred by the affected claimant.
  • Any cost reimbursement is subject to prescribed minimum and maximum limits.
