Entitlement to pension

Section 114 sets out the entitlement conditions and key definitions for the State Pension (Transition).

  • Anyone aged 65 who satisfied the contribution conditions in section 115 was entitled to State Pension (Transition) for specified periods of retirement.
  • "Yearly average" and "alternative yearly average" measure the claimant's contribution record over different timeframes, with the latter starting from 6 April 1979.
  • A "relevant person" is someone who first became insured on or after 6 April 1991, or who failed to meet certain contribution conditions but had periods of employment with paid or credited contributions.
  • The State Pension (Transition) was abolished for anyone reaching 65 on or after 1 January 2014.
