Recoupment of supplementary welfare allowance (continued)

Section 205 allows the recovery of overpaid supplementary welfare allowance from social security payments due from another EU Member State or the United Kingdom.

  • When a person receives supplementary welfare allowance in Ireland but is also entitled to a social security payment from another EU Member State or the UK that they have not yet received, an overpayment situation may arise.
  • If the supplementary welfare allowance paid exceeds what would have been granted had the person already been receiving their foreign social security payment, the difference is termed "the excess".
  • The designated person or deciding officer must certify the amount of this excess to the competent institution in the relevant Member State or the UK.
  • Once certified, the designated person or deciding officer may request that foreign institution to deduct the excess amount directly from the person's outstanding social security payment.
