Social Welfare Consolidation Act 2005 section 323

Appeals from certain determinations

Section 323 provides a right of appeal where a person is dissatisfied with the determination of a supplementary welfare allowance claim.

  • A person who is unhappy with a decision on their supplementary welfare allowance claim may appeal that decision.
  • The appeal relates to claims determined under sections 200, 201 or 202, which deal with allowances in kind, exceptional needs payments, and urgent supplementary welfare allowance respectively.
  • The appeal is made to a separate person who is appointed or designated by the Minister.
  • This ensures an independent review of the original decision by someone other than the person who made it.
