Social Welfare Consolidation Act 2005 section 46B

Rates of benefit

Section 46B sets out how the weekly rate of Partial Capacity Benefit is calculated and how it may change over time.

  • For claimants previously receiving Illness Benefit or Invalidity Pension, the personal rate of Partial Capacity Benefit is a percentage of their previous paymentβ€”50% for a moderate restriction, 75% for severe, or 100% for profound
  • For claimants qualifying through other routes, the weekly rate is prescribed by regulations
  • The rate adjusts automatically to reflect changes in circumstances or general increases in social welfare rates
  • Increases for qualified adults and qualified children continue at the same rate as applied to the original benefit
