Social Welfare Consolidation Act 2005 section 76

Increase of injury benefit and disablement pension for qualified adult and qualified children

Section 76 sets out how weekly injury benefit can be increased for claimants with dependants, and provides the basic rates according to degree of disablement.

  • The basic weekly rate of injury benefit is determined by the claimant's assessed degree of disablement, ranging from €57.00 at 20% to €285.00 at 100%.
  • Injury benefit increases for a qualified adult at the rate specified in Schedule 2, limited to one adult at a time.
  • Additional increases apply for each qualified child, with higher rates for children aged 12 and over than for those under 12.
  • Where the child also lives with the claimant's spouse, civil partner or cohabitant who is not themselves a qualified adult, the child increase is halved or removed entirely if that person's income exceeds the prescribed threshold.
