Revision by Chief Appeals Officer of decision of appeals officer

Section 318 empowers the Chief Appeals Officer to revise any appeals officer's decision at any time where that decision was wrong due to a mistake of law or fact.

  • The Chief Appeals Officer may revise any decision made by an appeals officer
  • There is no time limit on when such a revision can take place
  • A revision may be made where the original decision was erroneous due to a mistake relating to the law or the facts
  • The power is discretionary β€” it applies where it "appears to" the Chief Appeals Officer that an error occurred
