Social Welfare Consolidation Act 2005 section 68KI

Disqualifications (jobseeker's pay-related benefit)

Section 68KI sets out the circumstances in which a person may be disqualified from receiving Jobseeker's Pay-Related Benefit.

  • A person who loses their job due to a trade dispute at their workplace is disqualified from receiving the benefit while the stoppage continues, unless they find genuine alternative employment.
  • The trade dispute disqualification does not apply to workers who were not participating in or directly affected by the dispute, and separate departments within the same premises are treated as distinct workplaces for these purposes.
  • Participation in certain government employment schemes, specifically Community Employment and the Rural Social Scheme, disqualifies a person from receiving the benefit during any week of such participation.
  • A person may be disqualified for up to 9 weeks if they lost their job through misconduct, left voluntarily without just cause, refused suitable employment, or failed to pursue reasonable job opportunities.
