Disqualification

Section 237 sets out the rules on how receipt of a continued payment affects a person's entitlement to working family payment, including when the working family payment may still be paid despite that overlap.

  • As a general rule, a person receiving a continued payment is disqualified from also receiving working family payment.
  • An exception applies where the working family payment supplement would be greater than the continued payment β€” in that case, the person may receive the working family payment instead.
  • Where the exception applies, the Minister may reduce the working family payment supplement by the amount of the continued payment already being received.
  • The continued payment is then treated as having been paid on account of (i.e. as part of) the working family payment.
