Application for statement of recoverable benefits

Section 343P requires compensators (and the Personal Injuries Assessment Board) to apply to the Minister for a statement of recoverable benefits before making any compensation payment to or in respect of an injured person.

• A compensator must apply to the Minister for a statement of recoverable benefits before making any compensation payment to, or in respect of, an injured person.
• The Personal Injuries Assessment Board must likewise apply before issuing an order to pay.
• The Minister must issue the statement within 25 working days and must also send a copy to the injured person at the same time.
• The Minister may prescribe the information required for the application and the form in which it must be made.
