Social Welfare Consolidation Act 2005 section 68K

Disqualifications

Section 68K sets out the circumstances in which a self-employed person is disqualified from receiving jobseeker's benefit (self-employed).

  • Participation in Community Employment or the Rural Social Scheme disqualifies a person from receiving the benefit during any week of such employment.
  • Attending a course of study generally disqualifies a person, unless prescribed conditions and time limits apply.
  • Receiving proceeds above a prescribed threshold from selling or disposing of a self-employment business results in disqualification for up to 9 weeks.
  • Specific rules determine when a person is treated as "attending a course of study", including periods following second-level education and between academic years.
