Entitlement to pension

Section 153 sets out the three conditions a person must satisfy to qualify for the State pension (non-contributory).

  • The claimant must have reached pensionable age at the date of claim.
  • The claimant's means, assessed under the rules in Part 3 of Schedule 3, must not exceed the maximum threshold set out in section 156.
  • The claimant must be habitually resident in the State when making the application.
  • All three conditions must be met simultaneously for entitlement to arise.
