Disqualification

Section 61E sets out the circumstances under which a parent may be disqualified from receiving paternity benefit.

  • Regulations may disqualify a relevant parent or surviving parent from paternity benefit if they work while receiving the benefit.
  • Disqualification applies where the parent engages in any form of insurable employment, including employment covered for occupational injuries.
  • Insurable self-employment also triggers disqualification during the benefit period.
  • Certain other categories of employment and self-employment specified in Schedule 1 are similarly caught by these rules.
