Revocation of notice of attachment

Section 343I deals with the revocation of a notice of attachment that was issued to recover a social welfare overpayment.

  • The Minister may revoke a notice of attachment at any time by issuing a written notice to the relevant person.
  • Revocation is mandatory within 10 days if the overpaid person repays the relevant amount to the Minister.
  • The revocation notice must be in writing and directed to the relevant person (the party holding or owing funds to the overpaid person).
  • This provision ensures that attachment notices do not remain in force once the underlying overpayment has been settled.
