Social Welfare Consolidation Act 2005 section 87

Insurance against prescribed diseases and injuries not caused by accident

Section 87 extends occupational injury insurance to cover diseases and injuries caused by the nature of a person's work, not just accidents.

  • Workers insured against workplace accidents are automatically covered for prescribed occupational diseases and injuries developed on or after 1 May 1967.
  • The Minister prescribes diseases that are specific occupational risks rather than general health risks affecting everyone.
  • Benefits and conditions mirror those for workplace accidents, with regulations able to modify specific aspects.
  • Where a worker was employed in a prescribed occupation, the disease is presumed work-related unless proven otherwise.
