Social Welfare Consolidation Act 2005 section 146

Amount of increases payable in respect of qualified child in certain cases

Section 146 provides for the halving of the child increase in jobseeker's allowance where a qualified child resides with both the claimant and their partner, and the partner is not a qualified adult or falls within a specified category.

  • Applies where a qualified child normally resides with both the claimant and their spouse, civil partner or cohabitant
  • The increase for that child is paid at half the normal rate
  • Halving applies where the partner is not a qualified adult, or where the partner is receiving certain social welfare payments and the couple's means are already being halved
  • The main provision on rates of assistance must be read subject to this halving rule
