Social Welfare Consolidation Act 2005 section 213

Interpretation

Section 213 defines the key terms used throughout the Farm Assist chapter and sets out how a claimant's means are to be calculated, including the treatment of a spouse's or partner's jobseeker's pay-related benefit.

  • "Farming" covers owned, leased, or standalone farmland (including commonage) worked by the claimant for the purpose of husbandry β€” that is, extracting the traditional produce of the land.
  • "Weekly means" is the claimant's yearly means divided by 52, rounded up to the nearest €1 where the result is a multiple of 50 cent, or rounded to the nearest €1 otherwise.
  • Means are calculated in accordance with the Rules set out in Part 2 of Schedule 3.
  • Any jobseeker's pay-related benefit payable to the claimant's spouse, civil partner, or cohabitant is treated as if it were the claimant's own means.
