Social Welfare Consolidation Act 2005 section 119

Conditions for receipt

Section 119 sets out the PRSI contribution conditions that must be met to qualify for invalidity pension.

  • Claimants must have at least 260 qualifying contribution weeks since first entering insurance, plus 48 contribution weeks (paid or credited) in the last or second last complete contribution year.
  • The "relevant date" is typically the date after one year of continuous incapacity for work, where the person is subsequently proved permanently incapable of work.
  • Transitional rules reduce the 260-week requirement to 156 or 208 weeks for certain claimants whose invalidity pension entitlement began before specific dates in 1987 and 1988.
  • Regulations may modify these contribution conditions.
