Death benefit – orphans

Section 83 sets out who qualifies for orphan's death benefit, the form the benefit takes, and the weekly rate payable.

  • An orphan qualifies for death benefit if they were a child or step-child of the deceased, or were wholly or mainly maintained by the deceased at the date of death.
  • The benefit is paid as a weekly pension at the rate of €240.80.
  • The pension continues to be paid for as long as the orphan meets the qualifying conditions.
  • The rules governing guardian's payment (contributory) under section 133 also apply to this orphan's pension.
