Regulations relating to maintenance

Section 279 provides for regulations to determine whether a person is or is not to be regarded as wholly or mainly maintaining another person for the purposes of Part 2 (social insurance benefits).

  • Regulations may be made setting out the circumstances in which a person is deemed to be wholly or mainly maintaining another person.
  • The regulations may also specify the circumstances in which a person is deemed not to be maintaining another person.
  • These rules apply for the purposes of Part 2 of the Act, which deals with social insurance (PRSI-based) benefits.
  • The concept of "maintaining" another person is relevant to claims for increases in benefits payable in respect of adult or child dependants.
