Social Welfare Consolidation Act 2005 section 113A

Entitlement for invalidity pension recipients

Section 113A provides for the automatic transition from invalidity pension to State pension (contributory) when a person reaches pensionable age.

  • A person receiving invalidity pension immediately before reaching pensionable age automatically qualifies for State pension (contributory), but only one pension is payable under this Chapter.
  • The pension is normally paid at the age-referenced rate for age 66 as specified in section 111, regardless of the person's actual age when they qualify.
  • Where the person is also entitled to a pension from another EU Member State or the UK, they receive whichever is greater: the amount calculated under EU regulations or the UK arrangement, or the invalidity pension rate they would otherwise have received.
  • The weekly rate may be increased for a qualified adult, qualified children, living alone, being aged 80 or over, or residing on an island.
