Social Welfare Consolidation Act 2005 section 140

Interpretation

Section 140 defines key terms and explains how means are calculated for jobseeker's allowance purposes.

  • A "beneficiary" is any person entitled to receive jobseeker's allowance.
  • Weekly means is calculated by dividing yearly means by 52, then rounding to the nearest euro.
  • Any jobseeker's pay-related benefit received by a claimant's spouse, civil partner, or cohabitant is treated as part of the claimant's means.
  • For claimants already receiving jobseeker's allowance before 29 July 1992, earlier decisions about their means for qualification certificate purposes remain valid.
