Payment of allowance

Section 133 establishes who receives the guardian's payment (contributory) and defines "guardian".

  • The guardian's payment (contributory) is normally paid to the orphan's guardian.
  • A "guardian" is defined as the person with whom an orphan usually lives.
  • The Minister may direct payment to another person for the orphan's benefit instead of the guardian.
  • An orphan aged 18 or over who does not live with a guardian may receive the payment directly, subject to prescribed conditions.
